All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable laws of the UK. If you do not agree to these terms and conditions, please do not use this site. All purchases are made subject to these Terms and Conditions.
Product Information and Equipment Hire
The images on the website are examples of our cakes. All of our cakes are made fresh and can be made in different sizes and shapes from those shown on our website. Due to the bespoke nature of the cakes, your cake may have variations from a website image or other cake image of products made by Jan’s Occasional Cakes.
We offer the hire of equipment and cake stands. Hire of stands for wedding cakes are free of charge and we will provide the best-suited stand for your cake. If you have any requests for the hire of equipment or stands, please note during booking.
Please note that our goods may contain non-edible items or decorations, such as toys, plastic dowels in tiered cakes or wires in sugar flowers. These must be removed before serving or eating.
Pricing and Deposits
Our cakes are priced to reflect the size, decoration and production time for each cake(s). Prices may be higher for cakes that include more intricate detail used in the design, toys or toppers provided and any equipment used.
Please note that a 50% deposit must be made to reserve any date and equipment you require and is deducted from the total price to be paid. Deposits for cakes must be paid within four weeks of the agreed date and full payment must be made within one week.
Deposits for cakes are non-refundable due to any loss of business arising from turning away other orders for the agreed date.
Deposits for equipment will be refunded when the equipment is returned. Equipment must be returned with three days of the collection/delivery date of the cake or the deposit will be void. Any damage to equipment will incur a reduction of any deposit returned to cover the cost to restore or replace the item(s).
Bookings and Cancellations
Dates available are not guaranteed which is why we recommend ordering well in advance of the date the cake is required, suggesting a minimum of two weeks for occasion cakes. Additional notice is needed for wedding cakes and traditional fruitcakes; a minimum of three months notice.
Cancellations made with more than 14 days notice from the agreed collection/delivery date will be charged a 50% fee to cover credit card charges, specific ingredients/goods purchased and administration costs.
Cancellations made within 14 days of the delivery date will still be charged in full.
If you need to make alterations to your order, please contact us immediately. Any request for alterations to a cake must be submitted in writing for assessment by Jan’s Occasional Cakes. We will endeavour to make such alterations dependent on the design and amount of notice given and will notify you of the affect on the price and timescale. Accepting alterations if at the discretion of Jan’s Occasional Cakes once payments are made and work has started.
Collection and Delivery
All goods are to be collected at the date and time as agreed during booking and within shop opening times. If you wish to change this time, a minimum of 48 hours must be given to ensure availability. Collection times cannot be brought forward once work on your cake has started.
Wedding cakes delivered to a venue will be assembled/set up by an employee of Jan’s Occasional Cakes subject to availability.
Delivery times will be adhered to where possible. Jan’s Occasional Cakes will not be held responsible for delays due to accidents, severe weather conditions or unforeseen circumstances.
You will be asked to sign for your cake on transfer to accept that the cake is the correct order, you have understood the transportation advice, allergy advice and that the goods are no longer the responsibility of Jan’s Occasional Cakes.
While we try to minimise the chances of accidents occurring, no responsibility will be taken by Jan’s Occasional Cakes for any damage incurred during transportation, or at your home or venue, once transfer is complete. We will offer to try to repair any damage caused while in your care as long as there is availability. Such repairs may incur additional charges depending on the level of damage.
All payments to be made to Jan’s Occasional Cakes, including deposits, must be paid by the agreed time during booking, at which point all changes must be confirmed. Failure to do so may forfeit the agreement and may result in your order being cancelled and the specified date made available to other customers. Payments can be made earlier if you wish.
Work will not start on your cake until full payment is made. Any changes made to the previous agreed design may incur extra fees.
Payments can be made by cash, card or bank transfer.
We can accommodate for gluten free, vegan and other dietary requirements.
While every effort is made to keep ingredients separate in the case of allergen related illness, all cakes are baked and decorated in the same kitchen where traces of the allergens may transfer.
Storage and Consumption
All of our cakes are made fresh to order and do not contain any additives or preservatives. We advise that all cakes be consumed within a week of collection/delivery.
Cakes should be stored in a cool, dry place, preferably in the box in which it is supplied. Due to the nature of the ingredients and decorations used, it is not recommended to store the cake in a refrigerator as this may cause the decoration to spoil. It is also not recommended that goods be left in vehicles overnight or for long periods of time. Jan’s Occasional Cakes will not be held responsible for any spoilage that may occur after transfer due to incorrect storage.
Homemade fruitcakes must conform to our guidelines in order for us to achieve our high standard of decoration. They must be ready to be supplied to our kitchen a minimum for two weeks prior to the delivery/collection date.
Jan’s Occasional Cakes will not be held accountable for any flaws as a result of the cake being baked by someone other than our bakers.
Refunds and Disputes
In the unlikely event that you are disappointed with your cake, please inform Jan’s Occasional Cakes immediately. Complaints must be made in writing with any evidence included.
Please note that all cakes or foodstuff items are non-returnable under any circumstances.
Every care has been taken to create cakes based on the description provided by you the customer. Variations may occur in both design and specification as the manufacturers of the ingredients and decoration suppliers improve their products and due to supplier changes to icing colours.
Any cake based on a photograph of goods made by another cake maker shall solely be reproduced by Jan’s Occasional Cakes as our interpretation and shall not be an exact replication due to copyright laws and code of conduct.
Any refund regarding issues with a cake will be given at the discretion of Jan’s Occasional Cakes and will not be automatic. Full refunds will not be given for any cake that is partially consumed as consumption of these goods is your acceptance that the cake is adequate for the purpose of which it has been supplied.
Any negative comments regarding Jan’s Occasional Cakes made in any publication, whether online or in material, whereby Jan’s Occasional cakes has not been informed of the dispute and given fair opportunity to resolve any issues, shall void any possible refund and communication with you the customer will cease.
Any aggressive or abusive behaviour and/or comments made on your part during correspondence with any employee of Jan’s Occasional Cakes shall automatically terminate our contract of agreement and void any deposits and refunds eligible.
General Terms of Business
Jan’s Occasional Cakes shall not be liable for any consequential loss of the customer whether this arises from a breach of contract or any other way.
Total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Jan’s Occasional Cakes to the customer.
The customer’s statuary rights are not affected by any statement contained in these Terms and Conditions.
UK law applies to all transactions.
Jan’s Occasional Cakes reserves the right to use any images of our designs, whether taken by an employee of the Jan’s Occasional Cakes or used by you the customer in another media outlet. Such use may include in online or media publications, advertising and other marketing materials. Any images posted to a media outlet owned by Jan’s Occasional Cakes is your acceptance of the image being used in such publications and may be included as a testimonial for advertising purposes.
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. The term “outside parties” does not include Jan’s Occasional Cakes. It also does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.
However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
In the event that a Jan’s Occasional Cakes product is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Jan’s Occasional Cakes shall issue a credit to your account in the amount paid.
These terms and conditions are applicable to you once you access this site and/or complete the payment process. These terms and conditions, or any part of them, may be terminated by Jan’s Occasional Cakes without notice at any time, for any reason.
Use of Site
Harassment in any manner or form on this site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden.
Impersonation of a Jan’s Occasional Cakes employee or representative, as well as other members or visitors on the site is prohibited.
You may not upload to, distribute, or otherwise publish through this site any content which is slanderous, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
You may not upload commercial content on the site or use this site to solicit others to join or become members of any other commercial online service or other organisation.
Jan’s Occasional Cakes does not and cannot review all communications and materials posted to or created by users accessing the site and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Jan’s Occasional Cakes is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Jan’s Occasional Cakes reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Jan’s Occasional Cakes in its sole discretion.
By placing an order with Jan’s Occasional Cakes, either through our website, over the telephone, or by any other medium you are agreeing to these terms.
We collect information from you when you place an order, enter a contest or sweepstakes, respond to a survey or communication such as e-mail, or participate in another site feature.
When ordering, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information. You may, however, visit our site anonymously.
